Starting this school year, all Illinois K – 12 public schools are required to share information about IL ABLE accounts with parents and guardians of all students who have Section 504 plan.
If your school initiates a 504 plan for your child this year, or your child already has one, you must be provided with the IL ABLE informational brochure in exactly the same way your school shares and communicates with you about your child’s Section 504 Plan.
The new law expands on the current statutory requirement that all Illinois public schools distribute IL ABLE informational materials to parents or guardians of students with an IEP (individualized education program) at the student’s annual IEP review and when an IEP is established.

You are required to post IL ABLE informational material on your district’s website. Email able@illinoistreasurer.gov if you have questions or are not sure if your district is meeting the requirement.

Funds up to $100,000 in an ABLE account will not be counted as an asset for SSI benefits. Therefore, that money will not have to be “spent down” before they can receive benefits.
